Terms of Service
Effective Date: 10/1/2026
These Terms of Service (the "Terms") govern your use of Unique Artisans Marketplace (the "Service"), operated by Cominium Ventures, LLC ("Cominium," "we," "us," or "our"). By creating an account, making a purchase, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
If you sell on the Service, the Seller Agreement also applies to you. Our Privacy Policy explains how we handle your information, and our Refund Policy explains cancellations and refunds. Each is part of these Terms.
1. Eligibility and Accounts
- You must be at least 18 years old and able to form a binding contract to use the Service.
- You agree to provide accurate information and to keep it up to date.
- You are responsible for keeping your password secure and for all activity under your account. Tell us promptly if you believe your account has been used without your permission.
- We may refuse, suspend, or close accounts at our discretion, including for violations of these Terms.
2. Our Role
The Service is a marketplace where independent artisans ("Sellers") offer handmade goods to buyers. Sellers are independent businesses, not employees or agents of Cominium. Each Seller makes, describes, prices, and ships their own items and is responsible for them. We provide the platform, process payments through our payment processor, and provide shipping labels, but we do not make, inspect, or hold inventory of the items sold.
3. Buying on the Service
- Drops and availability: Many items are one of a kind and are released in scheduled "drops." Adding an item to your cart holds it for a short time, and starting checkout reserves it for a limited payment window. If a hold or reservation lapses, the item may be bought by someone else. An item is not yours until your payment is completed.
- Prices and shipping: Prices are set by Sellers and shown in U.S. dollars. Shipping charges are shown at checkout before you pay. Where required by law, Cominium collects sales tax on your order as the marketplace facilitator, and it is shown at checkout.
- Payment: Payments are processed by Stripe. We do not store your full card number. By paying, you authorize the charge shown at checkout.
- Order acceptance: In rare cases an item may become unavailable after you pay, for example if it sold at the same moment to another buyer. When that happens, we cancel the order and refund you in full automatically.
- Shipping: Sellers ship orders to the address you provide. We are not responsible for delays caused by carriers or by incorrect addresses.
4. Cancellations and Refunds
Cancellations and refunds are covered by our Refund Policy.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Post false, misleading, defamatory, or infringing content, including fake reviews
- Harass, threaten, or defraud other users
- Arrange to complete a transaction found on the Service outside the Service to avoid fees
- Use bots, scrapers, or other automated means to access the Service, buy items, or hold carts
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems
6. Content and Reviews
You keep ownership of content you post, such as reviews, photos, and shop content. You grant Cominium a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content in connection with operating and promoting the Service. You are responsible for your content and confirm that you have the rights to post it. We may remove content that violates these Terms.
7. Intellectual Property
The Service, including its design, software, and the Unique Artisans name and logo, is owned by Cominium and protected by law. Items, photos, and descriptions in shops belong to their Sellers. If you believe content on the Service infringes your rights, please contact us using the information below.
8. Third-Party Services
The Service relies on third parties, including Stripe for payments and shipping carriers for delivery. Your use of those services may be subject to their own terms, and we are not responsible for them.
9. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, Cominium disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Items are made and sold by Sellers, and Cominium does not guarantee their quality, safety, or legality, or the accuracy of listings. Handmade items may vary slightly from their photos.
10. Limitation of Liability
To the fullest extent permitted by law, Cominium will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid through the Service in the six months before the claim arose, or (b) $100.
11. Indemnification
You agree to indemnify and hold harmless Cominium and its officers, members, and employees from any claims, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms or of any law.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access at any time if we believe you have violated these Terms or to protect the Service or its users. Sections that by their nature should survive termination will survive.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to their jurisdiction. Before filing a claim, you agree to contact us and try to resolve the dispute informally for at least 30 days.
14. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page and update the "Effective Date" above. If you continue to use the Service after changes take effect, you accept the updated Terms.
